CAREER HIGHLIGHTS

Joining Hughes Watters Askanase in 1998, Henry focuses his practice on commercial and consumer financial services litigation. Prior to teaming up with HWA, Henry was a certified public accountant, serving as senior management consultant and auditor at Coopers & Lybrand, LLP.  Henry feels that his financial background in accounting and economics give him critical insight to identify pivotal aspects of a case and to offer sound advice and representation. Henry was admitted to the State Bar of Texas in 1997 and the State Bar of Illinois in 1996. He is also admitted to practice law in the U.S. District Courts of Texas (Southern, Western, Northern and Eastern), the Court of Appeals for the Fifth Circuit, and the U.S. District Court of Northern Illinois.

CLIENT EXPERIENCE

Henry's experience includes real and personal property lien disputes, certificate of title disputes, landlord-tenant disputes, statutory and common law unreasonable collection practices claims, Texas Home Equity lien disputes, bankruptcy proceedings, Truth in Lending Act (TILA) claims, Fair Debt Collection Practices Act (FDCPA) disputes, and Real Estate Settlement Procedures Act (RESPA) disputes.  Some of Henry's successes include the following:

  • Prosecuted dozens of real and personal property foreclosure actions involving simultaneous defense of lien challenges, unreasonable collection claims, fraud claims and deceptive trade practices claims.
  • Successfully defended a lender in a jury trial where the lender incorrectly accounted for property tax escrows at loan closing and through the first 18 months of the loan. The jury agreed with the defense argument that the lender violated no obligations resulting in damages to the borrower.
  • Representing numerous lawyers who find themselves the object of consumer protection statute claims including the federal Fair Debt Collection Practices Act.
  • Prosecuting and defending a number of businesses in commercial contract litigation.
  • Lead trial counsel and assistant on appeal in a recent case decided in favor of his client in the Texas Supreme Court. By recognizing the doctrine of equitable subrogation, the decision reversed the trial court and intermediate court of appeals holdings that invalidated a Texas home equity lien.
